Terms of Service

VIP Private Intensive

Effective Date: August 13, 2026

Last Updated: August 13, 2026

These Terms of Service (“Terms”) govern your purchase and participation in the VIP Private Intensive (“VIP Intensive”) offered by Drastic Results Marketing and Coaching (“Company,” “we,” “us,” or “our”).

Drastic Results Marketing and Coaching

363 N. Sam Houston Parkway East, Suite 1800

Houston, TX 77060

Email: Toni@ToniHarrisTaylor.com

By purchasing the VIP Intensive, submitting payment, checking a box indicating your agreement to these Terms, or participating in the VIP Intensive, you acknowledge that you have read, understood, and agreed to these Terms.

If you do not agree to these Terms, you should not purchase or participate in the VIP Intensive.

1. THE VIP PRIVATE INTENSIVE

The VIP Private Intensive is a personalized business strategy and networking service designed to help entrepreneurs, business owners, coaches, consultants, and professionals evaluate their current networking, sales, follow-up, and business-development activities and develop an actionable strategy.

The VIP Intensive currently includes:

  • One 90-minute private strategy intensive;
  • A review of the client's pipeline, offer, pitch, and networking positioning;
  • A customized 30-day follow-up blueprint;
  • A personalized 90-day action plan;
  • Up to 30 days of email support following the intensive; and
  • A pre-session questionnaire and preparation process.

The exact content and focus of the session may be customized based on the client's goals, circumstances, information provided, and professional judgment of the Company.

The Company reserves the right to reasonably modify the structure or method of delivery of the VIP Intensive when necessary, provided that the material value of the purchased service is not substantially reduced.

2. PRICE AND PAYMENT

The purchase price of the VIP Private Intensive is $497 USD, payable as a one-time payment unless otherwise expressly stated at checkout.

Payment must be successfully completed before the client receives access to scheduling and session-preparation materials.

Payments are processed through the payment processor presented during checkout. The Company does not directly store complete payment-card information.

By submitting payment, you authorize the Company and its applicable payment processor to charge your selected payment method for the amount displayed at checkout.

All prices are stated in U.S. dollars unless otherwise indicated.

You are responsible for any applicable taxes, currency-conversion fees, bank charges, or other fees imposed by your financial institution or applicable law.

3. NO REFUNDS AND ALL SALES FINAL CLAUSE

(1.) All Sales Final; No Refunds

The purchase of the VIP Private Intensive is final and nonrefundable. To the maximum extent permitted by applicable law, Drastic Results Marketing and Coaching (“Company,” “we,” “us,” or “our”) will not issue refunds, credits, transfers, or cancellations after payment has been submitted.

This policy applies regardless of whether the client:

  • Changes their mind;
  • Experiences a change in personal, professional, or financial circumstances;
  • Fails to complete the pre-session questionnaire or preparation materials;
  • Fails to schedule the VIP Intensive within the applicable scheduling period;
  • Fails to attend the scheduled session;
  • Arrives late or leaves the session early;
  • Requests a cancellation or rescheduling within less than 24 hours of the scheduled appointment;
  • Does not use all included email support;
  • Is dissatisfied with the client's business results or progress;
  • Does not implement the recommendations provided;
  • Determines that the VIP Intensive is not suitable for the client's circumstances; or
  • Experiences results that differ from the client's expectations.

The client acknowledges that the Company reserves time, preparation resources, scheduling availability, and other business resources in reliance on the client's purchase. The client further acknowledges that the VIP Intensive is a personalized service and that payment is not contingent upon the client's achievement of any particular business, financial, sales, networking, referral, revenue, or other result.

(2.) Satisfaction Guarantee Exception

The no-refund policy in this Section is subject only to the express terms of Section 5, Satisfaction Guarantee, of the VIP Private Intensive Terms of Service.

The Satisfaction Guarantee does not create an unrestricted right to cancel or receive a refund. A client may request consideration under the Satisfaction Guarantee only by following the procedure and satisfying all eligibility requirements stated in Section 5, including:

  • Contacting the Company at Toni@ToniHarrisTaylor.com;
  • Submitting the request within seven (7) calendar days after completing the VIP Intensive;
  • Attending and participating in the scheduled session;
  • Providing reasonably complete and accurate information necessary for the session; and
  • Participating in the session in good faith.

The Company will review any properly submitted request in good faith and determine whether it qualifies under the Satisfaction Guarantee. A refund or other remedy will be provided only if the Company determines that the request qualifies under the Satisfaction Guarantee and the applicable remedy is approved by the Company.

The Satisfaction Guarantee does not guarantee a particular business, financial, sales, networking, referral, revenue, or other outcome. A request based solely on a failure to achieve a particular result does not automatically qualify for a refund.

Except for a refund expressly approved under Section 5 or a refund required by applicable law, all purchases remain final and nonrefundable.

(3.) Scheduling, Cancellations, and Missed Appointments

This Section must be read together with Section 3, Scheduling, and Section 4, Rescheduling, Cancellation, and Missed Appointments, of the VIP Private Intensive Terms of Service.

A permitted rescheduling request made at least 24 hours before the scheduled appointment may be accommodated subject to Company availability. Rescheduling does not create a right to a refund.

A cancellation or rescheduling request made less than 24 hours before the scheduled appointment may be treated as a late cancellation. A missed appointment may be treated as a completed session. In either circumstance, the purchase remains final and nonrefundable, except as expressly provided under the Satisfaction Guarantee or required by applicable law.

If the client arrives late, the session will ordinarily end at the originally scheduled time. Unused session time does not entitle the client to a refund, credit, extension, or additional session.

If the Company needs to reschedule the VIP Intensive, the Company will make reasonable efforts to provide an alternative appointment. The Company may make reasonable exceptions for emergencies or circumstances outside the client’s reasonable control, but any exception is discretionary and does not establish a general right to a refund.

(4.) Refunds Required by Applicable Law

Nothing in this Section limits, waives, or excludes any refund, cancellation, rescission, chargeback, or other right or remedy that cannot lawfully be limited or waived under applicable federal, state, or local law.

If a refund is legally required, the refund will be limited to the amount and circumstances required by applicable law. Any legally required refund will not expand the Company’s obligations beyond those required by law.

The client is responsible for complying with any applicable deadlines, procedures, and notice requirements associated with a legally protected cancellation or refund right.

(5.) Clear Disclosure and Acceptance

The client acknowledges that the all-sales-final and no-refund policy is a material term of the purchase and is intended to be disclosed before or at the time of purchase.

By purchasing or participating in the VIP Private Intensive, the client confirms that the client has reviewed and accepted:

  • The final and nonrefundable nature of the purchase;
  • The scheduling, rescheduling, cancellation, and missed-appointment provisions;
  • The limited nature of the Satisfaction Guarantee;
  • The absence of any guarantee of business or financial results; and
  • The limitation that any refund is available only as expressly provided in Section 5, Satisfaction Guarantee, or as required by applicable law.

(6.) Conflict with Other Terms

If this Section conflicts with any other provision of the VIP Private Intensive Terms of Service, this Section will control with respect to refunds, credits, cancellations, and the final nature of the purchase, except to the extent that Section 5, Satisfaction Guarantee, or applicable law provides otherwise.

(7.) No Waiver of Mandatory Rights

The Company’s enforcement of this policy does not waive any right or remedy available to the Company. The Company will not enforce this policy in a manner that violates a nonwaivable right or protection under applicable law.

4. SCHEDULING

Following successful payment, the client will receive instructions for scheduling the VIP Intensive.

The session is not considered scheduled until an appointment has been successfully selected through the Company's scheduling system or otherwise confirmed by the Company.

The client is responsible for providing an accurate email address and for monitoring that email account, including spam, junk, promotional, and filtered folders.

Appointments are subject to availability.

The Company may establish a reasonable period within which the VIP Intensive must be scheduled and completed. Any such deadline communicated to the client after purchase will apply to the client's purchase.

5. RESCHEDULING, CANCELLATION, AND MISSED APPOINTMENTS

The Company understands that unexpected circumstances may occur.

A client who needs to change an appointment should use the rescheduling instructions provided in the appointment confirmation and provide as much advance notice as reasonably possible.

Unless the Company agrees otherwise in writing:

  • Rescheduling requests made at least 24 hours before the scheduled appointment may be accommodated, subject to availability.
  • A cancellation or rescheduling request made less than 24 hours before the appointment may be treated as a late cancellation.
  • A missed appointment may be treated as a completed session.
  • If a client arrives late, the session will ordinarily still end at the originally scheduled time.
  • If the Company needs to reschedule a session, the Company will make reasonable efforts to provide an alternative appointment.

The Company may make reasonable exceptions for emergencies or circumstances outside the client's reasonable control.

6. SATISFACTION GUARANTEE

The VIP Intensive is advertised with a 100% Satisfaction Guarantee.

The purpose of this guarantee is to provide the client with an opportunity to raise a good-faith concern if the VIP Intensive does not meet the Company's stated service commitment.

To request consideration under the satisfaction guarantee, the client must contact the Company at Toni@ToniHarrisTaylor.com within seven (7) calendar days after completing the VIP Intensive and explain the specific reason for the request.

To be eligible for consideration, the client must have:

  1. Purchased the VIP Intensive;
  2. Attended and participated in the scheduled session;
  3. Provided reasonably complete and accurate information necessary for the session;
  4. Participated in the session in good faith; and
  5. Submitted the satisfaction request within the seven-day period.

The Company will review each request in good faith and determine whether it qualifies under the satisfaction guarantee.

The satisfaction guarantee does not guarantee a particular business, financial, sales, networking, referral, or revenue result.

The guarantee is limited to satisfaction with the service provided and does not constitute a promise that the client will achieve any specific business outcome.

Important: The Company's public sales page and this section should be kept consistent. If the Company intends the guarantee to operate differently, this section should be revised before publication.

7. NO GUARANTEE OF BUSINESS OR FINANCIAL RESULTS

The Company provides strategy, education, networking guidance, sales and follow-up recommendations, and related business-development support.

However, the Company does not guarantee any particular result.

The client understands that business results depend on numerous factors outside the Company's control, including but not limited to:

  • The client's industry and market;
  • The client's products and services;
  • Pricing and positioning;
  • Sales ability and execution;
  • Networking activity;
  • Follow-up activity;
  • Existing relationships;
  • Available resources;
  • Economic conditions;
  • Competition;
  • Timing; and
  • The client's implementation of recommendations.

Testimonials, case studies, examples, revenue references, and other statements concerning results are provided for illustrative purposes and are not guarantees that a client will achieve the same or similar results.

The client is solely responsible for decisions made and actions taken in connection with their business.

8. NOT LEGAL, TAX, INVESTMENT, OR OTHER PROFESSIONAL ADVICE

The VIP Intensive provides business strategy and educational guidance.

The Company does not provide legal, accounting, tax, investment, securities, medical, or other regulated professional advice through the VIP Intensive.

Nothing provided through the VIP Intensive establishes an attorney-client, accountant-client, investment-advisor, fiduciary, medical-provider, or other regulated professional relationship.

Clients should consult an appropriately qualified professional for advice specific to their individual legal, financial, tax, investment, or other professional circumstances.

9. CLIENT RESPONSIBILITIES

The client agrees to:

  • Provide accurate and complete information;
  • Complete requested questionnaires or preparation materials;
  • Attend the scheduled session;
  • Participate actively and professionally;
  • Ask questions and communicate relevant concerns;
  • Take responsibility for evaluating recommendations;
  • Decide independently which recommendations to implement; and
  • Maintain appropriate internet, computer, telephone, and email access necessary to participate in the service.

The Company may rely on information provided by the client when preparing and delivering the VIP Intensive.

The Company is not responsible for recommendations or outcomes materially affected by incomplete, inaccurate, or misleading information provided by the client.

10. EMAIL SUPPORT

The VIP Intensive includes up to 30 days of email support following the private strategy session.

Email support is intended for reasonable questions, clarification, accountability, and implementation-related questions concerning the strategy developed during the VIP Intensive.

Email support does not include:

  • Unlimited consulting;
  • Additional private strategy sessions;
  • Extensive document creation;
  • Done-for-you marketing services;
  • Website development;
  • Technical implementation;
  • CRM setup;
  • Advertising management;
  • Sales representation; or
  • Ongoing business management.

Services outside the stated scope may be available separately and may require an additional fee.

The 30-day support period begins on the date of the completed VIP Intensive unless otherwise agreed in writing.

11. INTELLECTUAL PROPERTY

All Company materials, including but not limited to worksheets, templates, frameworks, methodologies, presentations, training materials, processes, systems, written content, graphics, videos, recordings, and other materials provided through the VIP Intensive (“Company Materials”) are owned by or licensed to the Company unless otherwise stated.

The client receives a limited, non-exclusive, non-transferable right to use the Company Materials for the client's own personal or business purposes.

The client may not, without prior written permission from the Company:

  • Resell Company Materials;
  • Distribute Company Materials to third parties;
  • Publish Company Materials for commercial distribution;
  • Reproduce proprietary materials as a competing product;
  • Claim Company Materials as the client's own;
  • Remove proprietary notices; or
  • Share paid or proprietary materials with individuals who did not purchase the applicable service.

The client's pre-existing intellectual property remains the client's property.

Nothing in these Terms transfers ownership of the client's intellectual property to the Company.

12. CONFIDENTIALITY

The Company will use reasonable efforts to protect confidential, non-public business information shared by the client during the VIP Intensive.

The client agrees to maintain the confidentiality of the Company's confidential and proprietary information, including proprietary frameworks, unpublished materials, internal processes, and confidential information concerning other clients.

Confidentiality obligations do not apply to information that:

  • Is publicly available through no breach of these Terms;
  • Was lawfully known before disclosure;
  • Is independently developed without use of confidential information; or
  • Must be disclosed pursuant to law, court order, or governmental authority.

Nothing in this section prevents either party from exercising rights or complying with obligations required by law.

13. RECORDING

The Company will not record the VIP Intensive unless the client is informed and any consent required by applicable law is obtained.

The client may not record, reproduce, publish, distribute, or commercially exploit the session or its contents without prior written permission from the Company.

If recording is authorized, all applicable privacy and recording laws must be followed.

14. THIRD-PARTY SERVICES

The Company may recommend or reference third-party software, websites, platforms, vendors, events, networking organizations, or other services.

The Company does not control third-party services and does not guarantee their availability, accuracy, security, performance, or results.

Any reference to a third-party service does not constitute a guarantee of that service.

The client's use of third-party services is governed by the applicable third party's terms, policies, and agreements.

15. PRIVACY

Personal information collected through the website, checkout, scheduling process, questionnaire, email communications, or other interactions with the Company will be handled in accordance with the Company's Privacy Policy.

The Privacy Policy explains how personal information may be collected, used, stored, and disclosed.

The Privacy Policy should be reviewed before purchase.

16. PROHIBITED CONDUCT

The client may not use the VIP Intensive, Company Materials, website, or Company communications to:

  • Engage in unlawful activity;
  • Commit fraud;
  • Misrepresent identity or business information;
  • Harass, threaten, intimidate, or abuse the Company or its representatives;
  • Distribute proprietary Company Materials without authorization;
  • Attempt to obtain services through fraudulent payment methods;
  • Interfere with Company systems;
  • Circumvent security measures; or
  • Use Company Materials to make deceptive or misleading representations.

The Company reserves the right to terminate or refuse services when reasonably necessary because of fraudulent, unlawful, threatening, abusive, or materially disruptive conduct.

17. TERMINATION OF SERVICES

The Company may terminate a client's participation in the VIP Intensive or related services if the client materially violates these Terms or engages in conduct that is fraudulent, unlawful, threatening, abusive, or materially disruptive.

Where appropriate, the Company may provide notice and an opportunity to correct the violation.

Termination does not automatically create a right to a refund unless otherwise required by applicable law or expressly provided under the Company's satisfaction guarantee.

18. DISCLAIMER OF WARRANTIES

To the maximum extent permitted by applicable law, the VIP Intensive and Company Materials are provided on an “as is” and “as available” basis.

The Company does not warrant that:

  • The service will produce a particular business result;
  • The service will be uninterrupted or error-free;
  • Every recommendation will be appropriate for every client;
  • Any third-party service will remain available; or
  • The client's business will achieve any particular level of revenue, profit, sales, clients, referrals, or growth.

Nothing in these Terms excludes any warranty or right that cannot legally be excluded under applicable law.

19. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Drastic Results Marketing and Coaching and its owners, officers, employees, contractors, affiliates, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to the VIP Intensive.

To the maximum extent permitted by applicable law, the Company's total aggregate liability arising from or relating to the VIP Intensive will not exceed the amount actually paid by the client for the VIP Intensive.

Nothing in these Terms limits liability that cannot legally be limited under applicable law.

20. INDEMNIFICATION

To the maximum extent permitted by applicable law, the client agrees to defend, indemnify, and hold harmless Drastic Results Marketing and Coaching and its owners, officers, employees, contractors, affiliates, and representatives from claims, liabilities, damages, losses, costs, and reasonable expenses arising from:

  • The client's material violation of these Terms;
  • The client's unlawful conduct;
  • The client's misuse of Company Materials; or
  • The client's violation of another person's rights.

This provision does not require the client to indemnify the Company for liability that cannot legally be shifted to the client.

21. FORCE MAJEURE

The Company will not be responsible for delays or failures caused by circumstances beyond its reasonable control, including severe weather, natural disasters, illness, public emergencies, government actions, internet or telecommunications failures, power outages, technology failures, labor disruptions, or other extraordinary circumstances.

When reasonably possible, the Company will make good-faith efforts to reschedule affected services.

22. ELECTRONIC AGREEMENT AND SIGNATURE

The client may accept these Terms electronically through the Company's website, checkout process, electronic form, or other electronic means.

By checking an agreement box, clicking an acceptance button, completing payment after being presented with these Terms, or otherwise affirmatively accepting these Terms, the client intends to enter into a legally binding agreement with the Company.

Texas law provides that an electronic record or signature may not be denied legal effect solely because it is electronic, and an electronic contract may not be denied legal effect solely because an electronic record was used in its formation.

The client agrees that electronic records of the transaction, including checkout records, acceptance records, payment records, emails, and scheduling records, may be maintained as evidence of the transaction.

23. GOVERNING LAW

These Terms and the relationship between the client and Drastic Results Marketing and Coaching will be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict-of-law principles, except to the extent applicable law requires otherwise.

Any dispute arising out of or relating to these Terms or the VIP Intensive will be subject to the jurisdiction of the appropriate state or federal courts located in Texas, subject to any applicable jurisdictional requirements.

The parties agree that Texas is the governing jurisdiction for purposes of these Terms to the maximum extent permitted by applicable law.

24. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be modified or enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

25. NO WAIVER

The Company's failure to enforce any provision of these Terms does not constitute a waiver of the Company's right to enforce that provision or any other provision in the future.

26. ENTIRE AGREEMENT

These Terms, together with the applicable checkout information, Privacy Policy, and any written agreement expressly incorporated into the purchase, constitute the entire agreement between the client and the Company concerning the VIP Intensive.

If a separate written agreement signed by both the Company and the client conflicts with these Terms, the signed agreement will control to the extent of the conflict.

27. CHANGES TO THESE TERMS

The Company may update these Terms from time to time.

The version of these Terms in effect at the time of purchase will generally govern that purchase unless a later modification is required by law or is necessary to address security, fraud, or similar operational concerns.

The Company will post updated Terms on the website and revise the “Last Updated” date.
